I owe on my consolidated student loans: they were sent to collections while I was in prison…?!! Help me?

I went to prison for drug charges, and now I am in a residential drug program. Is it legal–because it doesn’t seem viable–for an individuals account to be penalized in such a manner, while that individual is unable to take actions to correct the situation? Is there any possible way to appeal the action taken while I was incarcerated?

I don’t know if you can do anything about it or not, even with some legal help. The way everyone else is going to see it, is that you broke the law and went to prison. You could not pay the loan bills because you were in prison. You were in prison because of drugs, which is against the law. So, being that you can’t pay a bill which you “voluntarily” took on by getting a student loan because “you” broke the law, then the collectors or whoever is not going to be merciful.

Please don’t think I am being a butthole. I am in the military and after a couple of years, I understand how people of authority think. They don’t care about how you got into the situation you are in or why. All they see is that you got yourself into it. They also know that you know right from wrong. So regardless of what you saw growing up, or if you come from a broken home, or if you were in the wrong place at the wrong time or whatever could have possibly led to your situation. All they think is, you are responsible for your own actions.

So in their eyes you are responsible for your debt. Regardless of what has happened from the time you took on the loan until now.

Like I said, please don’t take this wrong. I am not lashing out at you or against you. I am just telling you how they are most likely thinking. I am not judging you or condeming(sp?) you.

So seek legal help ASAP. I wish you luck.
