Wage garnishment in the UK? Chasing down an American running from a civil court case/debts..?
A friend of mine co-signed on a student loan in the US, with the understanding that the primary borrower would pay on it and then refinance and get the cosigners name off the loan.
YEARS have passed, and the woman has refused to pay on the loan. The lender has decided to go after my friend instead of the primary borrower. My friend took the case to a civil court and won a judgement of $60k (the amount of the loan +interest). The court also found that the cosigner had committed fraud, which means the case can never be dismissed, even if she tries to get out of it by declaring bankruptcy (which she has done in the past). Before garnishment proceedings could be initiated she quit her job, left the country, and is now in England.
What can we do? How can wages be garnished from another country? My friend has always been responsible, paid her debts, and now she’s about to lose everything. She knows that cosigning was a mistake -but what can be done about it now? Please help!
