Question about tax refund and student loan garnishment. ?
My wages have been under garnishment since Feb. 2008. However, I still received a tax refund check in late February; it was filed jointly with my spouse. I also received a stimulus check in June. I had expected to rehabilitate my loan in December 2008 but because of the economic situation, the rehabilitation program has been suspended for now and my wages will continue to be garnished and I have no option for voluntary repayment. My financial situation is much improved but I am stuck now.
My question is: Is there any way for me to find out if my tax refund will be garnished? It was not last year, but I had only been under garnishment for about 1 month when I did my taxes. So perhaps the IRS missed it. I would like to find out ahead of time so my spouse can fill out the injured spouse form to relieve him from his portion being garnished too. Is there someone I can call? I think it varies state to state and I am in TX.
